NewYorkCountryLawyer writes "A group of 10 copyright law professors has filed an amicus curiae ('friend of the court') brief on the side of the defendant in Capitol v. Thomas, agreeing with the judge's recent decision that the $222,000 verdict won by the RIAA appears to be tainted by a 'manifest error of law.' The clear and well-written 14-page brief (PDF) argues that the 'making available' jury instruction, which the RIAA had requested and the judge ultimately accepted, was in fact a 'manifest error of law,' making the point, among others, that an interpretation of a statute should begin with the words of the statute. My only criticism of the brief is that it overstates the authorities relied on by the RIAA, citing cases which never decided the 'making available' issue as cases which had decided it in the RIAA's favor." As it turns out, the MPAA, close ally to the RIAA, has come forth with a more controversial view. They suggest that proof of actual distribution shouldn't be required. From their brief (PDF): "Mandating that proof could thus have the pernicious effect of depriving copyright owners of a practical remedy against massive copyright infringement in many instances."

CWmike writes "Linda Rosencrance reports that despite assurances from Google and Yahoo that their online advertising deal doesn't need regulatory approval, the two companies should not be too quick to dismiss Microsoft's influence on Capitol Hill. Andrew Frank, an analyst at Gartner, said both Yahoo and Google will benefit from the deal, but he also said Microsoft will do everything in its power to bring the arrangement to a screeching halt. 'Expect Microsoft to challenge it and come back aggressively with some search plans of its own,' he said. Rob Enderle, of the Enderle Group, said Microsoft is a formidable opponent and knows how to play politics. 'Without Microsoft, this probably would stand up to regulatory scrutiny,' Enderle said. 'But Microsoft has increased its presence on Capitol Hill significantly ... and there are restraint of trade issues, so by the nature of Google's size and because Microsoft is going to be pounding on a lot of doors, I think this is going to be a problem.'"

snydeq writes "The EFF and the Association of Corporate Travel Executives have filed an amicus brief with the 9th Circuit Court of Appeals requesting that the full court rehear and reverse a three-judge ruling (PDF) that empowers border agents routinely to search files on laptops and mobile devices. The case in question involves US citizen Michael Arnold, who, returning from the Philippines in July 2005, had his laptop confiscated at LAX by custom officials after they opened files in folders marked 'Kodak Pictures' and 'Kodak Memories' and found photos of two naked women. Later, when Arnold was detained, officials uncovered photo files on Arnold's laptop that they believed to be child pornography. In addition to raising Fourth Amendment issues, the amicus brief (PDF) reiterates the previous District Court ruling on Arnold's case regarding the difference between computers and gas tanks, suitcases, and other closed containers, 'because laptops routinely contain vast amounts of the most personal information about people's lives — not to mention privileged legal communications, reporters' notes from confidential sources, trade secrets, and other privileged information.'"

Alotau writes "Chinese hacking is getting some serious Congressional attention. Two House members said Wednesday their Capitol Hill computers, containing information about political dissidents from around the world, have been hacked by sources apparently working out of China. Virginia Rep. Frank Wolf says four of his computers were hacked. New Jersey Rep. Chris Smith says two of his computers were compromised in December 2006 and March 2007. The two lawmakers are longtime critics of China's record on human rights."

Ross writes "Of all the content management systems (CMSs) from which a Web developer can choose for creating a new Web site, Joomla is generally considered to be one of the top choices -- partly because an experienced developer can create an attractive site faster with Joomla than with the majority of other CMSs. However, Joomla's online documentation leaves much to be desired, as is true for most if not all CMSs. Intermediate and especially new developers need a clear and comprehensive resource that can explain the terminology, customization, administrative panel, and other aspects of Joomla. Interestingly, those articles (63-page PDF via Coral CDN) include not just complaints about signing statements and the war in Iraq, but also charges that the President "Sp[ied] on American Citizens, Without a Court-Ordered Warrant, in Violation of the Law and the Fourth Amendment,' 'Direct[ed] Telecommunications Companies to Create an Illegal and Unconstitutional Database of the Private Telephone Numbers and Emails of American Citizens,' and 'Tamper[ed] with Free and Fair Elections.' These are issues near and dear to the hearts of many here, so it's worth discussing. What little mainstream media coverage there is tends to be brief (USA Today, CBS News, UPI, AP, Reuters)." The (Democratic) House leadership has said that the idea of impeachment is "off the table." The Judiciary Committee has not acted on articles of impeachment against Vice President Cheney introduced by Kucinich a year ago.

schliz alerts us that ISO, in response to the four appeals (Venezuela, India, Brazil, South Africa) filed in recent weeks, has put the OOXML standardization process on hold. Here is ISO's press release, which says that ISO/IEC DIS 29500 will not be published for at least "several months" while the appeals process goes forward. Update: 06/11 10:13 GMT by KD : Reader Alsee points out that the fourth officially recognized appealing country is Venezuela, not Denmark as originally stated. The protests of Denmark and Norway are being disregarded, as they do not come from the administrative heads of their national organizations.

Denmark has become the fourth nation to protest the ISO's acceptance of OOXML, and Groklaw has a translation of their complaint. They now join India, Brazil, and South Africa. There are going to be plenty of questions about deadlines, because people have been given two different deadlines for appeals, and the final DIS of OOXML was late in being distributed and not widely available. In fact, that seems to be one of Denmark's complaints, along with missing XML schemas, contradictory wording, lack of interoperability, and troubles with the maintenance of DIS29500. In other words, we should expect a lot of wrangling over untested rules from here on out, and Microsoft knows how to deal with that."
