Thomas, agreeing with the judge's recent decision that the $222,000 verdict won by the RIAA appears to be tainted by a 'manifest error of law.' The clear and well-written 14-page brief (PDF) argues that the 'making available' jury instruction, which the RIAA had requested and the judge ultimately accepted, was in fact a 'manifest error of law,' making the point, among others, that an interpretation of a statute should begin with the words of the statute. My only criticism of the brief is that it overstates the authorities relied on by the RIAA, citing cases which never decided the 'making available' issue as cases which had decided it in the RIAA's favor." As it turns out, the MPAA, close ally to the RIAA, has come forth with a more controversial view. They suggest that proof of actual distribution shouldn't be required. Andrew Frank, an analyst at Gartner, said both Yahoo and Google will benefit from the deal, but he also said Microsoft will do everything in its power to bring the arrangement to a screeching halt. 'Expect Microsoft to challenge it and come back aggressively with some search plans of its own,' he said. Rob Enderle, of the Enderle Group, said Microsoft is a formidable opponent and knows how to play politics. 'Without Microsoft, this probably would stand up to regulatory scrutiny,' Enderle said. | Eff to fight border agent laptop searches snydeq writes "The EFF and the Association of Corporate Travel Executives have filed an amicus brief with the 9th Circuit Court of Appeals requesting that the full court rehear and reverse a three-judge ruling (PDF) that empowers border agents routinely to search files on laptops and mobile devices. The case in question involves US citizen Michael Arnold, who, returning from the Philippines in July 2005, had his laptop confiscated at LAX by custom officials after they opened files in folders marked 'Kodak Pictures' and 'Kodak Memories' and found photos of two naked women. Later, when Arnold was detained, officials uncovered photo files on Arnold's laptop that they believed to be child pornography. In addition to raising Fourth Amendment issues, the amicus brief (PDF) reiterates the previous District Court ruling on Arnold's case regarding the difference between computers and gas tanks, suitcases, and other closed containers, 'because laptops routinely contain vast amounts of the most personal information about people's lives — not to mention privileged legal communications, reporters' notes from confidential sources, trade secrets, and other privileged information.'" | Iso puts ooxml on hold schliz alerts us that ISO, in response to the four appeals (Venezuela, India, Brazil, South Africa) filed in recent weeks, has put the OOXML standardization process on hold. Here is ISO's press release, which says that ISO/IEC DIS 29500 will not be published for at least "several months" while the appeals process goes forward. Update: 06/11 10:13 GMT by KD : Reader Alsee points out that the fourth officially recognized appealing country is Venezuela, not Denmark as originally stated.
