Gallenod writes "The Denver Post is reporting that the U.S. 10th Circuit Court of Appeals has upheld the decision of a Federal judge who threw out and reversed a jury decision in favor of a patent infringement claim and ordered the plaintiff's lawyers to pay the defendants' court costs. U.S. District Senior Judge Richard P. Matsch sanctioned the plaintiff's attorneys for 'cavalier and abusive' misconduct and for having a 'what can I get away with?' attitude during a 13-day patent infringement trial in Denver. With the Appeals Court in agreement, could this case be the 'shot heard round the world' in the revolution against patent trolls?"

Fortunately, IBM's Rob Weir has a provided us a road map. Today Microsoft is due to submit its set of proposals for resolving the 3,522 comments to JTC1, which controls OOXML. Tomorrow or soon after, we can expect a media blitz heralding these 'changes,' as numerous reporters are, reportedly, being flown to Redmond. But all those recommendations are non-binding, because only JTC1 can change the standard and that happens during the Ballot Resolution Meeting. And even if all of the recommendations are adopted, no one has to change their vote. The BRM, where all the real work will happen, isn't until February 25-29. Within the 30 days after that, everyone will be able to reconsider their vote. That's when we can expect the real fireworks."

A little digging and text mashing reveals a website containing a Web 2.0 puzzle that makes notpron look like child's play. Penetration testing tv series coming

ChazeFroy writes "CourtTV (TruTV) has a new series starting Dec. 25 at 11 pm called 'Tiger Team.' It follows a group of elite penetration testers hired to test organizations' security using social engineering, wired/wireless penetration testing, and physically defeating security mechanisms (lock picking, dumpster diving, going through air vents/windows). They do all of this while avoiding the organizations' various security defenses as well as law enforcement. The stars of the show also did a radio spot this morning in Denver." Wonder how they socially engineer away the presence of a camera team in the air vents.

netbuzz writes "More big-time spammers may find themselves doing longer stretches behind bars if a federal judge's first-of-its-kind sentencing decision in a Denver case becomes widely applied. In a sense, these spammers would be hoisted on their own profits, as language in CAN-SPAM allows the use of their profits instead of the difficult-to-measure financial damage they cause in establishing a prison sentence. The Denver spammer earned $250,000 — and a 20% longer prison stint — using this approach."

Brown, a Network Administrator, called 911 last week when the Dell 9200 laptop burst into flames in his house. Emergency response units included two pumpers, a ladder truck, a bamalance, the HAZMAT unit, and a battalion chief. When Doug phoned Dell to inquire about liability, he was asked if he had insurance. It's not clear if Doug's laptop is one of the earlier models recalled by Dell; a Macbook is cited in the article for allegedly burning down a house in Australia as well as another instance of a suspect Dell laptop burning out a pickup truck in Nevada. If the burning battery issues are going to continue to be a problem, who's going to be responsible for losses? Insurance companies, Laptop makers, Battery vendors, and consumer negligence could presumably be cited in all cases."

Soe unveils in-game everquest tcg

Sony Online Entertainment this week stated they'd have a 'new announcement' on Friday at their annual Fan Faire player event. SOE President John Smedley addressed the assembled players, revealing an in-game trading card game that's to be rolled out to players of EverQuest and EverQuest 2 sometime before the end of the month. The game was developed by the SOE-Denver studio, the same folks who made online TCGs out of Pirates! and Stargate. Gamespot reports: "All current EQ and EQ2 players will initially receive a starter deck, and additional booster packs can be purchased with real-world cash. However, those wishing not to spend any extra money will be happy to know that booster packs can also be acquired as loot off of boss mobs in both games, and the game will be free of charge to play. Of further note, the game will feature loot cards that can be redeemed for in-game items for players' characters. SOE plans to offer substantial support for the product, including in-game tournaments, card trading, a unique user interface, and deck-building functionality."

NewYorkCountryLawyer writes "In an attempt to change the rules of the game, the RIAA secretly went to a federal district court in Denver with an ex parte application. The goal was to get the judge to rule that the federal Cable Communications Policy Act does not apply to the RIAA's attempts to get subscriber information (pdf) from cable companies. Just to clarify, ex parte means that the application was secret, no one else — neither the ISP nor the subscribers — were given notice that this was going on. They were, in effect, asking the Court to rule that the RIAA does not need to get a court order to be able to force an ISP to disclose confidential subscriber information. The Magistrate Judge declined to rule on the issue (pdf), but did give them the ex parte discovery order they were looking for."

An anonymous reader sends us to Boing Boing for a report that "the Director of Communications for the RIAA, Jenni Engebretsen, has been appointed Deputy CEO for Public Affairs for the upcoming Democratic National Convention in Denver." The DNC site has the official press release. Cory Doctorow notes that the RIAA is the most hated "corporation" in America, having beaten out Halliburton and Wal-Mart for the honor, and writes for the DNC's attention, "This represents a potential shear with the left-wing blogosphere."
